Yes, I have nominated myself queen of drama. There is something ALWAYS going on...and it seems to get worse before it get's better. However, I ride the roller coaster, and hang on tight! So what's new? Well, we moved our refrigerator from our old house to our new house a few weeks ago. Unfortunately, the line kinda broke from the wall that went to the water line on the fridge (you know, the one that goes to the auto ice maker etc). So, water sprayed all over the kitchen. My hubby went out to the main water line, and turned the water off to the house. A few days later, we called the water company and had the water shut off completely. Well......last friday (a week ago today) we get a call from our HOA (the old house Home Owner Association) telling us they need to contact us because they want to water the front lawn, but need us to turn off the main valve in our garage? Ohh... I contact them back IMMEDIATELY (thank god I didnt answer the phone, atleast I have her voice recorded on voice mail...stay tuned for reason why) I tell her, "DO NOT turn on the water! You will cause a flood in the house!". She says, "oohh, okay". Yeah, well, we get over there later in that same afternoon, and its too fucking late. The house is flooded...primarily the bedroom next to the kitchen. See, the water went through the grout, and under the wall. It flooded that room so bad, that.. well, I extracted over 32 gallons of water with my steam cleaner...just out of that one room. No shit. I video recorded it, as well as took pictures. Do we have homeowners insurance? No, it ran out midnight on June 3rd. The fucking vice president of the HOA came over that day, and told us they needed to turn the water on to water the grass, and that they had put the water in THEIR name on that prior tuesday..HOWEVER< he completely denied turning the water on at the main, and denied the flood as THEIR fault. Everything is documented, the story is bigger, but I am just plain fucking sick of talking about it right now. I cant deal with it anymore...not right now. I hope someone who knows a lawyer reads this. Should we sue? WTF do we do!!?? I dunno ...I just dont know.

Well, even though you speak about my dramatics, which I easily admit, I only have drama because something always happens with me...not because I exaggerate. I know what the facts are. The water went under the grout and wall and soaked the entire bedroom to complete SLUSH, not ONCE but TWICE now. I can put aside my emotions (which quite frankly makes me want to sue the pants off of them, and get entirely pissed off that they ruined Sarah's stuff. However, even IF I still had homeowners insurance which expired the third of this month, I have a 1k deductable..which her stuff did not get 1k in damages. Also, the house will no longer be mine soon...so they can worry about the mold (whoever THEY become..wether the HOA or the Bank). I am damn certain mold will grown between the walls. The carpet can be removed, but the mold will not be seen..alteast for some time. I have to realize it isn't my problem YET..since WHEN the new ownership takes place, "Whomever" MIGHT sue US for the damages! This scares me..but I can only sit around and wait. I have documented all that I could. I took pictures (which quite frankly don't do much justice...but I can upload them if you want to see..which I kinda wouldn't mind doing to get a different opinion). However, the video I took is much better. I walked around in her room and you can hear the slushing sound with my feet. I took better footage of the wall damage in the corner by the closet, and the water going through to the outside stucco. Yeah, it got wet enough to damage the stucco. At this point, the best defense I have is just that, to keep on the defensive. I documented everything, and that is all I can do for now...even though I am pissed off as hell at them. When we talk on the phone, I can tell you more. In the meantime, I will just sit and wait to see what blossoms. I have gotten conflicting opinions from people who know me and live here. One says "sue them first, or they will sue you". Another says "don't sue them, document everything and if they sue you, then you have proof..then counter sue". I liked the second option, so I am sticking with it for now. The HOA has been complete assholes to us for 3 years, and I have documentation that they are doing shady stuff with the accounting and running the HOA..but that is another story. I brought up their accounting 'mishaps' in a meeting one night, and have been shit on ever since. They want us out so bad, THEY are liening us before the damn bank...even though they will get NOTHING from the upside down sale. That is how bad they want me gone ( I know too much of their frivelous accounting practices...like 30,000 dollar differences in the HOA account). Too bad the homeowners there are all over 60...alteast most. They don't like someone young with a brain coming in and finding out their scheme. Hense, why they want me out so bad.
Anyway, I will get SKYPE, you told me about it before...and I will download it.

Cindy, its a little complicated for me to comment further upon but I would be concerned about mold that you might not be able to see. You'd be best to speak to someone familiar with what can happen under the circumstances you have spoken of.
Then you will know whether or not you need to move ahead further with a lawyer. If you do, you will likely need to pay somthing in the vicinity of $100-200 for a consultation, at which point he or she can determine IF youi have a case or not as they will be dealing with the facts rather than emotions.
Don't take this the wrong way but you tend towards histrionics, or as you say, dramas, so its hard to tell from your post if a lawyer would have a legitimate file or your emotions have overblown it a bit.

I am moving this week and only next will i finally begin to slow down after a very hectic past year. I know Shelagh, and ironically, I thought about asking you. However, it has been so long since I called you, so I didn't even know if you had the same number after your split. Not only that, but I never know when you will be online anymore. Regardless, I took video, printed out pictures, and logged all encounters. I also kept the voice mail from the secretary of the association, and even forwarded it to my husbands voice mail...so we would definately have it. Right now, after I extracted all the water..things don't look so bad. Also, I sprayed more Lysol Mold and Mildew, in hopes of stopping any growing mold. Hopefully, nobody notices water damage. I mean, the carpets can be replaced. The damage that is visible on the wall is minimal, and can be painted over. Things can cosmetically be covered. If they decide to sue (which I assume would now be the bank...because if the association decides to proceed with foreclosure, then the association would sue) Then the association already knows of the damage, and doesn't have a fricken leg to stand on. We shall see.

Cindy, Cindy, Cindy, you should have asked me. Remember, I ONLY date Jewish men and you should know that every good second Jewish boy grew up to be either a doctor or a lawyer.......lol

Seriously though, my "companion" is in his early 50's and he is now semi-retired from the legal profession but at the time he owned 47 law firms. He walked away from it a couple of years ago, ( full time ) to open up a restaurant and he is much happier now doing that, although he still has a large file in Europe and flies to London every 2 months or so to deal with it.
My closest g/'f is a lawyer but she deals only with women’s issues. As well a few other friends are lawyers and I have been working as a legal assistant/secretary for the past 2 years.

Now, that said?
Every end of the law is different from the next. A criminal lawyer will not be familiar with corporate law, or tax law for example A divorce lawyer won’t know the first thing about entertainment law, etc, etc, etc...

As well, we are all Canadians.

In any event, experience has shown me that you a really do need to speak to a lawyer for here you may not be telling the full story, you might be omitting a crucial detail that will make all of the difference.
Go see a lawyer,………take all of the necessary papers with you and see what he or she has to say about it all .
Then let us know afterwards, what he/she said to you (within reason, you don’ need to give all of the details, but perhaps a yes or not to whether u have a case or not in which to proceed)

Well, to top it off, they have put a lien on our home as of earlier this month. We have thirty days to pay our back pay, or they will foreclose on the house LMAO! They are foreclosing before the bank is! Not only that, but we are upside down in the home. So, they won't get their money back...I think the obvious reason they are doing it is because they are assholes. I wonder if they still wanna foreclose after knowing they completely ruined the inside? Time will tell. They can shove that house up their asses now.

Wow! I honestly don't know what I would do. I've never been part of a HOA.
